  • WAIVER AND DISCLAIMER

    Each person entering the Competition (each such person, an "Entrant") agrees to be bound by the Rules and Conditions of Entry set out below (the "Rules").

    The decisions of the Competition jury are final. Yamana Gold Inc. ("Yamana Gold") reserves the right to modify or cancel the Competition, or any portion thereof, at any time for any reason including, without limitation, in the event of technical corruption, virus, bugs, non-authorized human intervention or any other technical problems.

    Yamana Gold reserves the right in its sole discretion to disqualify any Entrant whom it finds to be in violation of these Rules or in breach or potential breach of any of Entrant’s representations or warranties contained herein.  Yamana Gold reserves the right in its sole discretion to refuse a submission from any Entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter.

    Entrant expressly consents to Yamana Gold and its affiliates, advertising and promotional agencies, and each of their respective directors, officers, employees, agents, representatives and assigns (collectively, the "Yamana Gold Parties") storing, using and disclosing the information submitted or provided by Entrant for any purpose the Yamana Gold Parties deem appropriate including, without limitation, for administering the Competition. Entrant expressly grants to the Yamana Gold Parties an unlimited license to use the Entrant’s name, photograph, images of the artwork submitted by Entrant ("Entrant’s Work") and any related materials, or any part thereof, for any purpose the Yamana Gold Parties deem appropriate, including, without limitation, in connection with promotion of this Competition, other competitions and for internal or external media, and Entrant waives any claims to royalty, right or remuneration for such use by the Yamana Gold Parties.

    Entrant represents and warrants to the Yamana Gold Parties that Entrant’s Work: (a) is original work, (b) does not infringe upon the copyrights, trademarks or other intellectual property, privacy or other rights of any person or entity, (c) has not been previously published and (d) has not received any previous awards. Entrant further represents and warrants that the publication of Entrant’s Work by the Yamana Gold Parties will not infringe on any third-party rights.

    Entrant grants to Yamana Gold an exclusive option to purchase Entrant’s Work at the price set by Entrant in Entrant’s submission. This option begins from the moment the entrant makes the online submission and ends on December 31, 2012.

    No liability or responsibility is assumed by any of the Yamana Gold Parties for failure of any submission by an Entrant to be received. No liability or responsibility is assumed by the Yamana Gold Parties resulting from an Entrant’s attempt to participate in this Competition or if required, download any information necessary to participate in this Competition.  Entrant indemnifies and holds harmless the Yamana Gold Parties resulting from any breach of Entrant’s representations and warranties contained herein or from loss or damage of any kind arising from or in connection with Entrant’s participation in the Competition.

    This Competition and the Rules of the Competition shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein.

    All dollar amounts are in United States funds.

    Art Competition 2012

    THE INVITATION

    "Passion to Perform" is a competition which celebrates the success of Yamana Gold, and we are looking forward to engaging creatively in a way that reflects our company's diversity and core values.

    We invite you to create a work of art entitled "Passion to Perform", inspired by our company and core principles.  Please use this title as a guide only; there is no need for literal interpretation or for entrants to feel restricted by any artistic spirit or flair.

    The submitted artworks can be in the form of paintings, photography, sculptures and drawings.

    Winning submissions will be displayed on a range of communication materials, as well as in our corporate offices in Toronto, Canada.

    PRIZES

    The following three prizes will be awarded. First prize $6,000, second prize $2,500 and third prize of $1,000.

    THE JUDGES

    The judges have been invited from a range of backgrounds;

    -       Representative from the Art Gallery of Ontario (AGO)

    -       Members of the Board of Directors, Yamana Gold including the CEO

    -       Mrs. Jane Marrone, artist and competition founder

    ENTRY PROCESS

    The competition is open to any person practicing art. The initial entry is online, followed by a second round of short listed works before final selection.

    The panel of judges will initially review initial entries through an online digital submission process. Following this, approximately 35 short listed artists will be invited to deliver their actual works through a regional collection process sponsored by the company.

    Only works that are short listed from the initial digital submission will be reviewed for final judging. Notifications and instructions on the regional collection process will be sent to the short listed artists only via email.

    KEY DATES

    12 October: Deadline for online email entries, by 5pm EST.

    26 October: Results of initial entry, including short listed notices and instructions on mailing of works are emailed to artists by this date.

    November 2: Results of final round of judging and award notices

    RULES AND CONDITIONS OF ENTRY

    Works entered must be an original composition created by the entrant. There is no maximum size or specific dimensions for the work.

    Entrants should submit digital images of the art work in PC compatible jpg file(s) with a resolution of 300 DPI or higher. The website for digital submissions is http://form.jotformpro.com/form/21866982290969

    All entrants will be required to agree to the waiver and disclaimer found in the electronic submission form in order to enter the competition.

    All of the short listed works will be transported to the corporate offices of Yamana Gold in Toronto, Canada, using regional collection centres set up by the company with reputable courier firms. The cost of shipment and insurance of the short listed entries will be borne by the company.

    The entrant must specify the price of works in the online registration form as part of the initial online entry. This price will form the 'catalogue selling price' (in the event the corporation wishes to acquire the work). This price is independent of shipping and insurance which will be borne by the company.

    Notwithstanding the foregoing paragraph, submissions that are awarded any of first, second or third prizes become the property of Yamana Gold and none will be returned.

    All artists and participants by applying to the competition, agree to participate in media interviews and any other public relation events to promote their work and the competition.
