- RELATIONSHIP AND RESPONSIBILITIES
1.1. Happy Tails Pet Sitting Services, LLC (HTPSS) undertakes to perform the agreed-on services in an attentive, reliable and caring manner and the Owner undertakes to provide all necessary information to assist in this performance.
1.2. The Owner agrees to keep up to date with HTPSS policies as these policies are subject to change. Policies can be found at: www.happytailsep.com
- COMPENSATION
2.1. HTPSS shall be paid the full amount calculated in accordance to the services provided and deductions may be made for late departure or early return of the Owner.
2.2. Additional fees may include the purchase of necessary items for the care of the pet(s), including but not limited to pet food, litter or cleaning supplies, transportation, unexpected visits and emergency expenses for health care. HTPSS shall retain and submit receipts as proof of additional expenses.
2.3. The full amount calculated in accordance to the services that will be provided, shall be payable in advance and payment of the balance affected within 3 days of receipt of the account for the outstanding balance.
- DURATION
3.1 The Owner authorizes this contract to be valid approval for future services of any purposes provided by this contract permitting HTPSS to accept telephone and electronic reservations for service and to enter the premises without additional contracts or written authorization.
3.2. The onus shall be on the Owner to confirm his/her return and his/her availability to resume care of the property and pet(s). HTPSS may provide additional visits in the interest of the pet(s) if the Owner cannot be reached after the end date of the Owner’s reservation. Any additional visits or duties shall be calculated according to the amount of visits and type of duties provided.
- CANCELLATION OR TERMINATION
4.1 Credit will not be given with same day notice of early arrival. If credit amount is less than $50, it must be used within 6 months. Credits over $50 do not expire. Any changes to bookings are subject to a $10 change fee. Any services booked/scheduled over a holiday will be subject to a $30 cancellation fee per holiday day. Credit will not be given with an early arrival home or late departure. The cancellation fee will not apply if cancelled within 24 hours of the booking confirmation. Booking extensions over holidays during active services subject to $30 holiday extension fee per holiday. The extension estimate must be paid prior to extension start date.
4.2. Should any pet become aggressive or dangerous, HTPSS may:
4.2.1. Arrange with the pet's Guardian to assume responsibility of the pet until the Owner's return.
4.2.2. Place the pet into a kennel or animal care facility at the Owner's expense if the Guardian is unable or unwilling to assume responsibility for the pet.
4.2.3. In either event as described in 4.2.1. and 4.2.2. above, this contract shall be deemed terminated unless HTPSS agrees to continue with other home caring duties and/or caring for other listed pets at no reduction in compensation.
4.3. Termination under the circumstances described in 4.2 above shall not entitle the Owner to any refunds nor relief of any outstanding payments due.
- LIABILITY
5.1. HTPSS accepts no liability for any breach of security or loss of or damage to the Owner's property if any other person has access to the property during the term of this agreement.
5.2. HTPSS shall not be liable for any mishap of whatsoever nature which may befall a pet or caused by a pet who has unsupervised access to the outdoors.
5.3. The Owner shall be liable for all medical expenses and damages resulting from an injury to HTPSS caused by the pet as well as damage to the Owner's property.
5.4. HTPSS is released from all liability related to transporting pet(s) to and from any veterinary clinic or kennel, the medical treatment of the pet(s) and the expense thereof.
- INDEMNIFICATION The parties agree to indemnify and hold harmless each other as well as respective employees, contractors, successors and assigns from any and all claims arising from either party's willful or negligent conduct.
- EMERGENCIES In the event of an emergency, HTPSS shall contact the Owner at the numbers provided to confirm the Owner's choice of action. If the Owner cannot be reached, HTPSS is authorized to:
7.1. Transport the pet(s) to the listed veterinarian.
7.2. Request on-site treatment from a veterinarian.
7.3. Transport the pet(s) to an emergency clinic if the previous two options are not feasible.
- SECURITY
8.1. HTPSS warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Owner and to return same to the Owner immediately on demand. Happy Tails reserves the right to properly dispose of any keys or openers on file for clients that have not utilized our services within 2 or more years. Clients are fully responsible to request a key return before disposal.
8.2. HTPSS will not share the responsibility of your home or pet(s), unless HTPSS approves Pet Guardian to care for the home and pet(s) do to certain arising conflicts.
8.3. HTPSS will not provide services if Owner requests HTPSS to keep their doors unlocked or have their patio doors left open for pet(s) to have yard access.
8.4. HTPSS reserves the right to utilize images of client pets only, for social media purposes. The client must provide verbal or written declination of consent of use of photos of their pets.

RELAXATION OF TERMS No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this Pet Sitting Contract on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

BINDING EFFECT The terms of this Contract shall be binding upon and accrue to the benefit and be enforceable by either party’s successors, legal representatives and assigns.

GOVERNING LAW This Pet Sitting Contract and Agreement shall be construed, interpreted and governed in accordance with the laws of the State of Texas and should any provision of this Contract be judged by an appropriate court as invalid, it shall not affect any of the remaining provisions whatsoever.
- GENERAL The parties agree that any or all parts of this agreement may be submitted to the other party in legible and recordable electronic form and upon acknowledgement of receipt by the receiving party shall become valid parts of the agreement.
