Shine Terms and Conditions
All athletes enrolled or participating in any Shine event or related event must be have a current Member Profile prior to participation.
All purchases, including but not limited to training fees, Elite Team Fees, and Coaching fees are final and not subject to return or refund at any time. In the event that an athlete cannot complete the duration of their training plan or participate in a planned event, cancels their membership plan, or in the event of a cancellation/change to our schedule, the purchaser agrees that they shall still be responsible for any remaining payments related to their team or Membership/Pass. Any fees paid and not used towards the planned or alternate schedule will be applied as credits to the player's account with Shine to be used towards future training or fees.
It is the customer's responsibility to check and confirm their orders, sizing requests, colors, quantities and any and all other applicable details prior to finalizing any orders or payments.
UPDATED COVID WAIVER AND GUIDELINES
INFORMED CONSENT AND ACKNOWLEDGEMENT - Participation in any Colorado Shine Events requires acceptance of the following:
I hereby give my approval for my child’s participation in any and all activities prepared by Colorado Shine Basketball LLC and or Shine Basketball Academy LLC (herein referred to as the "Company"). In exchange for the acceptance of said child’s candidacy by the Company, I assume all risk and hazards incidental to the conduct of the activities, and release, absolve and hold harmless the Company and all its respective officers, agents, and representatives, as well as the Owners, Directors, Principals, Executives, Leadership, Management or any and all other associated persons related to any venue or facility used by the Company, from any and all liability for injuries, illnesses, sickness or any ailment affecting said child in any way arising out of traveling to, participating in, or returning from selected programs and events.
In case of injury to said child, I hereby waive all claims against the Company, including all ownership, leadership, staff, coaches and affiliates, all other participants, sponsoring agencies, advertisers, and, if applicable, owners and lessors of premises used to conduct the event. I understand without any confusion that there is a risk of being injured or coming in to contact with communicable disease or viruses that is inherent in all sports activities, including basketball. Some of these risks include, but are not limited to, the risk of fractures, paralysis, or death, infection of communicable disease, illness, sickness, or other ailments that may result in individual physical response ranging from minor to fatal consequences. I accept all of these risks, as well as all other associated risks not mentioned herein, on behalf of my child (or for myself if an adult) and my family, and my participation in any and all activities offered by the Company and its affiliated ownership, agents and members, Rob Pierson Coaching, Rob Pierson Consulting LLC and all associated organizations is without exception of my own free will and I willingly accept all the risks stated, related, or implied herein.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Colorado Shine Basketball (“the Company”) has put in place preventative measures to reduce the spread of COVID-19; however, the Company cannot guarantee that you or your child(ren) will not become infected with COVID-19, or any other disease or illness for that matter. Further, attending any Company events or programs could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending programs and activities offered by the Company and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 by attending programs and activities offered by the Company may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Company employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Company or participation in Company programming (“Claims”).
HOLD HARMLESS AND AGREEMENT TO WAIVE LEGAL ACTION
On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Company, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Company, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Company program.
MEDICAL RELEASE AND AUTHORIZATION
As Parent and/or Guardian of the named athlete, I hereby authorize the diagnosis and treatment by a qualified and licensed medical professional, of the minor child, in the event of a medical emergency, which in the opinion of the attending medical professional, requires immediate attention to prevent further endangerment of the minor’s life, physical disfigurement, physical impairment, or other undue pain, suffering or discomfort, if delayed. Permission is hereby granted to the attending physician to proceed with any medical or minor surgical treatment, x-ray examination and immunizations for the named athlete. In the event of an emergency arising out of serious illness, the need for major surgery, or significant accidental injury, I understand that every attempt will be made by the attending physician to contact me in the most expeditious way possible. This authorization is granted only after a reasonable effort has been made to reach me.
Permission is also granted to the Company, and its affiliates including Directors, Coaches, and Team Parents to provide the needed emergency treatment prior to the child’s admission to the medical facility.
This release is authorized and executed of my own free will, with the sole purpose of authorizing medical treatment under emergency circumstances, for the protection of life and limb of the named minor child, in my absence.
