  • MISSION STATEMENT

    To actively promote and support rational access for the safe and effective use of all medical marijuana/cannabis products, as a natural alternative, for healthy living and overall wellness; in accordance with California Regulatory Guidelines.
  • PURPOSE

    The purpose of the above-named entity (“Mystic Blue Holistics Collective and Delivery”) are in general, to promote the betterment of the community which it serves in general, and in particular; to provide alternative herbal remedies to its Patient Members; who all shall be California residents with current medical marijuana recommendations from their licensed physicians;
  • A) To establish a not for profit entity, in order to facilitate rational and safe access to medical marijuana products for the treatment of various medical conditions pursuant to California State Law, for which use may provide relief of symptoms and/or reduce pain associated with many medical conditions;

    B) To help ensure sufficient supplies and quality assurance of all medical marijuana and medical marijuana/cannabis products in order to meet the collectives membership needs.

    C) To provide confidential access for members in an open and secure forum for  the information/education related to the use of natural alternatives such as medical marijuana, potential interactions with concurrent prescription drug therapies, and other options for healthy living and wellbeing; 

    D) To provide members with a platform for the lawful possession of medical marijuana and medical marijuana/cannabis products, pursuant to a current State of California approved medical card and/or a current recommendation from a qualified licensed Physician; 

    E) To participate and abide by California regulations governing the procurement, distribution, possession and utilization of all medical marijuana/cannabis products in accordance with Prop 215 and SB 420 

  • GOVERNANCE

    The Governing Body will be composed of active members of the Collective; who shall maintain appropriate medical and financial records, up hold Membership Rules/Regulations and By-Laws, mediate contract affiliations with members and/or affiliated partners, and facilitate the necessary consultants to provide for the Collective Memberships ongoing needs. The Governing Body shall be composed, at minimum, of the following Primary Officers:
  • CHAIR - Responsibilities include oversight of operations, marketing, business practices and communications, daily office needs, and employee/volunteer services (if needed). In concert with CO-CHAIR, to develop materials and services that provide for the ongoing needs of the membership, and to ensure that all Regulatory Guidelines are followed accordingly.

    CO-CHAIR - Responsibilities include oversight of not for profit business practice records, medical communications, membership newsletters, and other required documents. In concert with the CHAIR, to develop materials and services that provide for the ongoing needs of the membership, and to ensure that all Regulatory Guidelines are followed accordingly.

    FACILITIES MANAGER -  Responsibilities include oversight of facilities and building needs, safety and security, daily agriculture needs (if needed), and day to day facility operations. In concert with the CHAIR and CO-CHAIR, to provide for the ongoing needs of the membership, while ensuring that all Regulatory Guidelines are followed accordingly.

    INVENTORY MANAGER - Responsibilities include oversight of inventory and office supplies, delivery services, product quality assessment, and agricultural areas (when needed). In concert with the CHAIR and CO-CHAIR, to provide for the ongoing needs of the membership, while ensuring that all Regulatory Guidelines are followed accordingly.

    MEMBERSHIP SERVICES MANAGER - Responsibilities include oversight of membership records, general meeting minutes, communication of events and services, and mediate complaints and/or other member-related situations. In concert with the CHAIR and CO-CHAIR, to provide for the ongoing needs of the membership, while ensuring that all Regulatory Guidelines are followed accordingly.
  • In addition to the above PRIMARY OFFICERS, the Governing Body may also provide for additional positions required to maintain appropriate member services and business practice standards.

    Additional positions shall be composed of "Contract Affiliates", “Consultants”, or “Volunteers” as appropriate, and may include the following types of services:

    Legal Consultant

    Accountant/Bookkeeper

    Safety and Security

    Medical Information Consultant

    Information Technology

    Distribution Services

  • The Primary Officers of the Collective shall maintain said position(s) until such time they decide to terminate affiliation with the Collective, they no longer wish to hold said governing position, or they are deemed unable to provide continued support for the role(s) in which they serve.

    Consultants/Volunteers shall maintain said position(s) for a term of not less than 1 consecutive year(s), at which point the Collective may decide to restructure such Leadership Roles, hire out duties to specialized consultants, and/or elect alternative individuals into said position(s).

    Changes to the By-Laws shall be voted upon by the Collectives Members during General Meetings. Final approval for business practice changes within the Collective shall be conferred to Primary Officers ONLY, using consensus bases decision making principles, and shall require majority[>51%] of voting officers to approve proposed actions. 

    The CHAIR and CO-CHAIR shall maintain the responsibility to direct/redirect decisions and approve/deny proposed actions, as needed to support the overall goals and objectives of the Collective, in alignment with the Collective’s Business Plan and Regulatory Guidelines. General Membership meetings shall be held at least once a quarter to review current business practices and records, and/or propose further actions needed to facilitate services needed to provide for the Collective’s members. Notification of Membership meetings, prior meeting minutes (and other pertinent information) shall be sent out to the Membership two weeks prior to the proposed meeting date. Any updates or changes to existing practices and By-Laws, will be communicated to the Membership through Newsletters and/or any other appropriate forums.

    Contracted affiliates may be employed for as long as necessary, shall serve no specific term requirements, and may have affiliate agreements terminated at anytime, with provision of a 30 day notification from the CHAIR/CO-CHAIR of the Collective. In addition, consultants shall not maintain voting privileges within the Collective (except as a Member during general sessions); however, suggestions and recommendations 

    shall be strongly considered when advising on the ongoing support of the Collective, and documentations provided as such during general meetings.

    Nothing in the above shall prohibit and Officer or Consultant from being affiliated with another Cooperative or Collective, non-profit organization, and/or having another part time or full time employer. Any potential "Conflict of Interest" should be reported to the CHAIR/CO-CHAIR for further review and consideration, prior to the accepting an active position or role within the Collective.

  • VOLUNTEERS and EMPLOYEES

    The Collective may also engage volunteers or can employ members of the Collective for the purpose of providing member services and business practice needs. Members are encouraged to volunteer time, experience, and resources needed to support the Collective, so that expenses can be minimized and Regulatory intent can be optimized.   • COMPENSATION

    No part of the income of the collective shall be payable or otherwise available for the personal benefit of any proprietor, member or officer. The Collective may obtain various contracted affiliates or employees, who may receive appropriate compensation for their services related to necessary business practices, not provided by the Collectives Membership. Furthermore, Consultants of the collective may receive reasonable compensation for their services; as related to investment of time, value of resources provided, position equivalent market wages, reimbursement of business-related expenses, professional services of appropriate consultant fees, ect. Any compensation provided to consultants of the Collective will be negotiated on an individual level, and shall be recorded and maintained in accordance with the Collectives not for profit goals and objectives. Compensation may be provided in a variety of methods, as negotiated by the individual and may be composed of any of the following alone or in combination: membership and product discounts, free services and supplies, business related expense support, gifts, and/or appropriate financial remuneration, ect. Nothing shall prohibit the individual from donating their time and services without receiving suitable compensation. All compensation exceeding a direct expense reimbursement, or $25 equivalent numeration, shall be subject to review and reporting to State and Federal Taxation Boards (as 1099 compensation). No Manager/Officer of the Collective shall receive remuneration for such leadership services; however he/she may be appropriately reimbursed for all reasonable expenses associated with said duties and Collective affairs. Expense reimbursement shall be provided upon submission of the Officer’s personal expense report, pending review of pertinent documentation, and will not be considered financial compensation or reported accordingly.
  • ACCESS and SECURITY

  • Any officer, consultant, employee or volunteer of the Collective who directly handles, transports, or cultivates marijuana for the Collective MUST have a valid California Medical Marijuana Recommendation from a California State Licensed Physician, a California Medical Marijuana Card issued from your local County Health Department or equivalent documentation. If at anytime, the individuals medical card or physicians recommendation is unavailable for review, has been revoked, or is questionable/expired; the individual may be prohibited from access to the premises and/or any activity that directly relates to the management of medical marijuana.Access to the Collectives medical marijuana supplies and premises shall only be pursuant to appropriate review and approval of a qualified Membership Application. Safety and Security of the Collectives facilities, supplies and membership information shall be maintained at all times; in accordance with operational standards and Regulatory Guidelines.

    If access to the facility is required for maintenance and/or security by an individual that does not possess a qualified medical card or physicians recommendation; he/she MUST be accompanied by an Officer at all times and the immediate area must be secured such that the potential for diversion is effectively reduced and/or eliminated.

    No persons under the age of 18 shall be permitted on the premises, regardless if accompanied by a legal guardian. The Collective shall primarily engage members that are 18 years or older, having duly completed a qualified membership application, and having appropriate medical need(s) as defined by the intent of Proposition 215 and SB-420. No persons under the age of 18 shall obtain services from the Collective. Furthermore, the Collective shall in no way discriminate against qualified members on the basis of sex, race, sexual orientation, appearance, and/or appropriate medical condition.

    Although safety and security of the Collectives facilities is to be appropriately maintained at all times, at no such time shall dangerous weapons or firearms be permitted on the premises (except as provided by contract security services). Any person(s) found in violation of the Regulatory Standard, shall be immediately dismissed from the premises, and have said membership revoked.

    The Collective may employ security guards, install security devices and systems, maintain guard dogs, or other options as needed to ensure the safety of their Members and its supplies.

    Only members with an AUTHORIZATION TO TRANSPORT OR CULTIVATE for the Collective, will be allowed to do so on the premises, or as an agent of the organization. This authorization may be revoked at anytime by the Officers, if deemed appropriate, or if the member holding such authorization has violated said Rules and Regulations. This does not prohibit the Collective from obtaining supplies from other Collectives or Cooperatives for which it may be affiliated, in order to provide a variety of products and services for the Members of the Collective.

    Nothing outlined above shall prohibit individuals who do not possess a valid card or physicians recommendation from being secured by the Collective to facilitate its business practice needs, as long as direct access to the Collectives medical marijuana products is eliminated. In addition, nothing shall prohibit the Collective from complying with State, Federal, and Local Law Enforcement and/or City Agencies that may have jurisdiction over regulation of medical marijuana and adjunct business practices, requiring access to the premises and its records for review and evaluation.
  • MEMBERSHIP

  • Members of the Collective shall possess a CURRENT and VALID Physicians Recommendation or California State Issued MMP Card issued by the County Health Department. Members are encouraged to participate in Collective activities and services, and to provide constructive feedback to its Officers, in order to promote continued improvements in quality of products and services to the Members of the Collective. No Membership fee shall be required by the Collective.

    All members agree to abide by the Collectives Rules and Regulations. Any member found in violation of such regulations and/or guidelines; may receive a warning notification, be temporarily suspended, or have their membership revoked and be escorted from the premises. Members are encouraged to report potential violations and/or suspicious activities by other members to a Collective Officer for further review and evaluation, so that the unsafe and/or inappropriate actions do not place the Collective or any of its members in jeopardy.

    Officers retain the right to periodically review and contact members to ensure that personal information is correct and up to date, medical marijuana recommendations remain active and in good standing, and that the member is regularly participating in activities and services. If a member is found to have an expired card or physicians recommendation on file, then he/she may be contacted to verify a current card and/or recommendation prior to the provision of future delivery, access, or services. No services will be provided for those members that have expired cards/recommendations, until such time as appropriate paperwork is submitted to the Collective.

    Unless specifically indicated otherwise by the Physicians recommendation, general guidelines will be used to reference utilization quantities and rates, but no maximum or minimums will be placed on supplies and/or services rendered by the Collective. In the case of a member who has not been active or used the Collectives services for more than three (3) months, he/she may be notified of pending review, and possible dismissal from membership, pursuant to further evaluation. This may be especially pertinent if City or State Regulations place additional restrictions on the amount and/or type pf membership individual Cooperatives/Collectives may contain. Officers may also place a limit on membership numbers and types of patients as necessary, in order to provide a more safe and effective access for its members.
    All members shall conduct themselves according to societal norms, and in a safe and rational manner when accessing and using Collective services. No member shall use marijuana/alcohol/other illicit drugs on the premises, or surrounding area(s), nor shall they provide marijuana obtained for medical treatment to an individual that does not possess a current and valid physicians recommendation and/or MMP card issued from the County Health Department for the purpose of recreational use. Any member caught doing so, will be considered in violation of Collective Rules and Regulations, will be immediately dismissed, and may be considered involved in drug trafficking pending further investigation by Local Law Enforcement.
    Nothing shall prohibit members from actively joining or participating in other local Cooperative or Collectives. In addition, no restrictions shall be placed on those who may become a member based on place of primary residence, as long as he/she meets the qualification for membership and maintains a local address for services within the Collectives area.
  • MEDICAL MARIJUANA

  • The Collective supports the safe and appropriate access to organically grown medical marijuana (Cannabis) and its derivatives or preparations, for the treatment of various health-related conditions under the guidelines of Proposition 215 and SB-420. Some medical conditions that may benefit from the use of medical marijuana are:

    Oncology - pain, appetite and nausea/vomiting

    HIV- pain, appetite and nausea/vomiting

    Migraine or Cluster headaches

    Muscle-Skeletal Disorders

    Pain Disorders 

    Insomnia

    Anxiety Disorders

    And any other medical condition the Physician and Patient determines to be effective

    Members acknowledge that the use of medical marijuana is by recommendation ONLY, and that there are studies published more and more demonstrating evidence for the use in the treatment of many health-related conditions. In addition, some prescription medications, alcoholic substances, over the counter medications, and illegal drug substances may adversely interact with the therapeutic components (THC & CBD) within medical marijuana, and members should consult their health professional before initiating or combining therapies. Since data is being collected daily, but is still conflicting or lacking, Collective Members/Officers/Volunteers may only provide general recommendations(s) for specific varieties of cannabis that may be more effective in alleviating certain medical conditions. Recommendations given by Collective Members are not considered medical facts, and should not be substituted for appropriate Physician consultation and regular healthcare.

    The Collective shall provide for a variety of cannabis strains, understanding that most common varietals available today are blends of the two primary species (sativa and indica). Members are also aware that the effects of each strain are not only based on the species subtype and THC/CBD content, but the individual crops growing conditions and members personal response, as well. Therefore, although the Officers shall attempt to ensure the highest quality product at all times, minor variations within separate lots may exist, even among the same strain(s). Members are encouraged to provide feedback regarding the effects of specific strains and lots, so that future recommendations can be more readily tailored to the members needs, in addition to helping to ensure that only the highest quality products and supplies are maintained by the Collective for the members.

    The Officers shall review and evaluate member feedback and any complaints regarding its products, in order to ensure that the highest quality products are maintained by the Collective at all times. If a particular lot/supplier is found to not meet the quality standards of the Collective, then the Officers may choose to not obtain further supplies from said provider, and may provide subsequent credit or discount to its members accordingly.

  • EVENTS and SERVICES

  • Pursuant to the guidelines set forth in Proposition 215 and SB-420 and not for profit designation, the Officers shall direct additional funds (less expenses) back into the Collective. This shall be done in order to further promote the safe and appropriate access for members,  enhance and improve on Collective services, provide for membership rewards, improve and enhance community support and education on the value of medical cannabis needs,  and support its ongoing business practice needs. Examples of membership services, membership rewards,  and building community support may include, but are not limited to:

    Discount Coupons and/or Specials

    Reward Certificates

    Collective Sponsored Member Events

    Gifts and Tokens

    Expansion of Services, Location(s) and Hours

    Charitable Donations on behalf of the Collective

    Cannabis Campaign Support

    Or any other recommended and approved by the Collective members

    Members may receive notification of events and rewards through a variety of methods, such as text messages, emails, mailings, facebook notifications, tweets, ect. All members are encouraged to participate in Collective events, suggest potential rewards, and/or offer recommendations that may improve and further promote the safe and appropriate use of medical marijuana.
